LIMITED SIX-MONTH WARRANTY: SKILLZBOARD 

IMPORTANT- PLEASE READ

BY USING YOUR SKILLZBOARD PRODUCT OR ANY PART THEREOF, YOU  AGREE TO BE BOUND BY THE TERMS OF THE SKILLZBOARD LIMITED SIX MONTH WARRANTY (“WARRANTY”) AS STATED BELOW.  

PLEASE DO NOT USE YOUR SKILLZBOARD PRODUCT OR ANY PART  THEREOF UNTIL YOU HAVE READ THE TERMS OF THIS WARRANTY (“TERMS”).  IF YOU DO NOT AGREE TO THE TERMS, DO NOT USE THE PRODUCT OR ANY  PART- PLEASE RETURN IT ACCORDING TO SKILLZBOARD’S RETURN POLICY  FOR A REFUND. 

Limited Warranty 

Section 1- General 

Unless otherwise stated in writing, any Skillzboard item purchased directly from Skillzboard (“Product”) is covered by this Warranty. Skillzboard (“Company”) warrants that any Product purchased by the buyer will be free of functional defects in materials and/or  workmanship under normal use for a period of six (6) months following the date of  purchase, as evidenced by a copy of the purchase receipt. 

Section 2- Warranty Limitations 

In consideration of the warranties in Section 1 by the Company, the original purchaser (“Buyer”) of the Product or Part agrees to and accepts the following: 

- This Warranty supersedes and replaces all other warranties, expressed or  implied; 

- All warranties of merchantability or of fitness for a particular purpose are hereby  excluded and/or waived;  

- The Buyer’s sole remedy shall be a replacement or refund of the Product or Part  from the Company; and 

- The Company shall be indemnified and held harmless by the Buyer against any  loss or injury caused, in whole or in part, by its actions, omissions, negligence, or  any issue beyond its reasonable control. 

Section 3- Refund or Replacement 

If, in the judgement of the Company, the Product or any part thereof (“Part”) is  defective, the Company, at its discretion, will replace the Product or Part or refund the price paid for the Product or Part. No replacement or refund shall be available for a  Product or Part that suffers damage due to an accident, abuse, improper storage or 

use, neglect, improper installation, improper cleaning, failure to follow instructions, or  abnormal wear and tear. Changing or altering the Product or Part in any way voids this  Warranty. Cosmetic damage that does not impair the use of the Product or Part, or that  does not render the Product or Part unusable, is not covered under this Warranty.  

Section 4- Secondary Buyers and Warranty Time Period 

This Warranty is non-transferable from the Buyer to any subsequent buyers or users. A  replacement item does not re-start or otherwise constitute a new Warranty or warranty  period. Upon delivery of the replacement Product or Part, the original Warranty time  period will continue. 

Section 5- Returns for a Replacement or Refund 

The Buyer must notify the Company of a request for replacement or refund under this  Warranty within thirty (30) days of discovery of the defect. Upon receipt of a request  from Buyer, the Company alone will determine whether a warranty issue exists. If a  warranty issue exists, the Company shall refund or replace the Product or Part within  thirty (30) Business Days (defined as any day Monday through Friday, not including US  bank holidays) of physical receipt of the defective Product or Part, or within thirty (30)  Business Days of the Company’s determination that a replacement is not feasible. The  Company reserves the right to make all determinations as they pertain to this Warranty  without the input of the Buyer. The Buyer is responsible for timely shipping of the  Product or Part; the Company shall not provide paid shipping for returns. All returns  seeking a refund or replacement must follow the Company’s Return Policy.
